Retro Pop

I have finished my painting Woooo Hooo!!!!  I am in love with the colors in this painting and can not wait to paint more in this series:)  I'd like to do a larger version of this piece and I have a really cool, very large (for me) painting from this series that I have coming up soon.

Work In Progress Wednesday: "Retro Pop"

Today I'm sharing my progress with you:))  Can't wait to share the finished painting with you on Monday!  I absolutely love the colors in this painting and I can't wait to do some more in this series.  I do have to take a break in there and get ready for a workshop I'm teaching on Friday.  I'm trying a new painting with this workshop and I'll tell you all about it next week.

I do hava couple spots available in my "All That Shines:  The Art of Painting Glass in Watercolor" May 15-17th workshop in Baton Rouge, LA.  That will probably be my last workshop in the United States for a while since we are packing up and moving to Japan.

"Vintage Appeal"

I'm finally finished. I have a couple tweaks to do but other than that I'm calling this one done. I started this painting during my workshop in February. I'm going to do a modified version for my upcoming workshop in Baton Rouge, LA in May.

We are in clean out and sort mode as we prepare to move to Japan. I can't believe it is already March even though looking outside it still looks like December. Time is flying by.

Beginning again

Hi Everyone,

No  I didn't fall of the planet.  I did however get the flu and so did my husband.  Both my sons were down too, one had a double ear infection and the other pneumonia.  So it de-railed my painting every day for 30 days attempt.  But I did paint, I just didn't have time to post.

After I finished Banned.  I decided to take a break from the bulbs and switch to another painting I'm planning on doing with my workshop coming up in February 7 &8.  Visit Louisiana Watercolor Society for details.  I want to complete the large painting  and then demo on an 8x10 size.

So I started this one called "Vintage Appeal".  But I just wasn't finished with the lightbulbs and kept thinking about them and I have a deadline for a competition that I is knocking on my door so I decided to stop and start "Incandescent.

This is the beginning stage of "Incandescent" I've spent 2 days so far. One day on the drawing and another on the painting.  I need to paint with the speed of light to pull this off by my deadline so wish me luck.

And just my luck when you have deadlines and need to get images resized for competitions my computer decided to do some weird update that screwed everything up.  So after a very helpful conversation with Apple support my computer issue was resolved and after installing my latest Adobe update I think my photoshop problems are in the past.  Phew!!!  Technology is the best and worst:)

My Big Secret

All weekend long I have been harboring a secret.  Have you ever received information that just doesn't seem real, like you'll wake up and it was all a dream.  Last week I received a call from Daniel Smith Art Supply Co.  I didn't answer either time they called because it was an 800 #, finally the Director of Sales left me a message.  I called back and got her voice mail.  We finally touched base around 4:30 Thursday afternoon.  She said "Are you sitting down?", "You are the Grand Prize winner of the 11th Annual online art competition.  My mind went spinning in a thousand directions.  "Are you sure?" I replied.  "Yes, she said and why haven't you been answering the phone."  She was thrilled to get to call the winners and was dying for me to answer the phone.  So I have won a trip for 2 to Seattle, $1000 spending money and a full art studio, which from the contest rules it states it's a full shawn taboret.  The package is worth $10,500.  They're calling back with the details.   I'm almost equally excited because Laurin McCracken won last year and I am a huge fan of his work.

I'm thrilled and still a bit in shock!  And I really hope they make the official announcement soon, just so I can see it in writing:)  Oh and my painting will be on the Daniel Smith catalog going out August 1st.  Somebody pinch me!!!!

Thank you to everyone that voted to get my painting into the final round.  Seriously, I'm still in shock!!

Guest Blogger: Kim Minichiello- Trademarks, how do they affect artists

Today I have a guest blogger Kim Minichiello.  Kim came to my rescue and explained trademark issues to me after I had a situation occur with a local organization.  I found the information to be so important that I asked her to do a series of blog posts about trademarks and copyrights.

Recently Carrie had a situation with an organization not accepting a painting of hers into their show because the subject matter was Ball canning jars, and they were concerned about an infringement of trademark.  I can fully understand an art organization, and we as artists, wanting to protect our rights be it with trademarks or copyrights. The decision not to accept Carrie’s painting was based on having incorrect knowledge of trademark infringement.  I posted a comment on Carrie’s blog and we have been conversing about this issue on Facebook in the past few days. Carrie asked me if I would do a guest post regarding trademark and copyright, and I told her I would be happy to!

I’m not an attorney, I’m an artist, and I don’t profess to be an expert on trademarks and copyrights, but I do have some experience and knowledge on the subject matter.  I co- founded a company a few years ago creating digital art for the art licensing market.  Some of the designs that I created were to be mass-produced, utilizing vintage images so, I wanted to be sure that by using them I wouldn’t be infringing on anyone’s trademark or copyright.  At that time, I had an Intellectual Property Attorney, and the information I will be passing on is from my own research that was validated by my attorney and information she passed on to me.  There is also information on the US Government’s Trademark and Patent web site. http://www.uspto.gov and the United States Copyright Office web site, http://www.copyright.gov.

What is a trademark?

A “trademark” is any word, name, or symbol (logo), used by a manufacturer or merchant to identify goods or services, to distinguish them form those of others, and indicate their source.  Trademarks include the “brand” names of the goods, for example, BallTM canning jars, CokeTM and AppleTM.  The reason a company would want to trademark their name is to distinguish their goods and services from others.  The value of the trademark depends on the degree of recognition and goodwill associated with the mark by the buying public.  You would want your customers to recognize your name and mark to identify with what you sell, or a service you provide, as opposed to the goods and services of others, your competitors. 

Trademark law is the branch of law of unfair competition.  It would be unfair for someone else to pass off the same goods or services your company provides, in which you have spent time and money building up your brand to be recognized by the general public.  If a competitor that provides the same goods or service you do is using a similar name or logo, or even if the name sounds the same, there would be confusion between the two brands.  An example of this would be when the Beatles had a problem with Apple (computers) using the Apple name and logo to sell music.  The Beatles had previously trademarked Apple Corp. Ltd. and Apple Records and used an apple as a logo to sell music.  Therefore, they were claiming that Apple had infringed on their mark by using the name “Apple” and using an image of an apple to sell the same goods, music. (I’m happy they worked out an agreement, this was the reason the Beatles’ music wasn’t available on iTunes for a while.)

If a company doesn’t register their mark with the United States Government Patent and Trademark Office your mark can only be protected in the particular geographic region in which you do business, and you would have the burden of proving the extent of that area.  A mark with Federal Registration would extend your area of coverage to the whole country.  If you were to do business countrywide and want to establish your brand to sell certain goods, then it would be wise to Federally Register your mark.   Incidentally, when you see a “TM” next to a name or logo, the company is indicating that that name is trademarked, whether it’s registered with the United States Patent and Trademark Office or not.    If they follow through and Federally Register the mark, they can then use the “R” with the circle, ®, after the company name or logo.

How do trademarks affect me as an artist?  

Most artists use their names as their brand or logo.  Should an artist trademark their name?  This really isn’t necessary, unless you plan on being the next Andy Warhol.  If you are then it may be worth your time. (There are nine current trademark registrations for him for a wide variety of products.)  Also, if you were to pursue many licensing opportunities to have your art appear on a wide variety of products, like artists Mary Engelbreit, Laurel Burch, or Thomas Kinkade, then yes you should register your name.

Where it affected Carrie is when the organization she submitted her work to, to be juried in their show, thought they might be infringing on the Ball company’s trademark by displaying the work, or that Carrie had infringed on the mark by using the Ball jars in her artwork.  Neither case is an infringement of the mark.  Carrie would only be infringing on the Ball’s trademark, if she were to produce canning jars and use the same or very similar logo on the same or similar product as they manufacture.  The Ball trademark in Carrie’s piece is on the jar in her art.  There would be no confusion within the general public that Carrie is selling Ball jars.  She is selling her art with images of Ball Jars.  If the Ball Jar company wanted to use Carrie’s art to help sell their product, then they could license her image to do so, but that’s a whole other topic!

As an artist using a product like the Ball jar in your work, or in Chris Beck’s art, Peeps candy, they are using what is called “fair use” which allows an artist to use a trademarked company’s product in your own art which you can sell. Andy Warhol didn’t violate the Campbell Soup trademark or the Brillo Pad mark in his work either.  This isn’t an issue because Campbell makes and sells food, and Brillo makes soap pads, not original art or art prints.  When a company applies for a trademark they have to list the goods and or services they will be providing with that mark. The Ball Company does not list art or art prints in their goods and services with their registered mark. Therefore, there is no confusion amongst consumers and no infringement.

There is a situation where this could get a little gray.  Say the Ball company listed “mugs” as part of their goods and services registered under their mark, and Carrie were to mass produce and sell mugs with her image of the Ball jars on the mug.  The Ball Company at that point may have an issue with that, but it is still unlikely, there still would be no confusion between Carrie’s brand and what she sells and the Ball Company’s brand and what they sell.  Carrie would have to make and sell a lot of mugs and be making a substantial amount of money for it to be an issue.  If it did become an issue with Ball then they would simply ask Carrie to “cease and desist” selling mugs. 

The bottom line is Carrie is not infringing on Ball’s mark by painting their jars, and the art association would not be infringing on their trademark by accepting and displaying her work in their show. 

Between trademarks and copyrights, it is a copyright that affects artists more.  The next article I will do for Carrie will cover copyright. Stay tuned!

I revisited my ball jars again for this commissioned piece.  I had fun saturating the colors even more than in the "Preservation" painting.  These are both from the same reference photo I just played with the color.   I love seeing how many gorgeous colors I can get reflecting and pouring through these vessels.

"Blue Skies", Show acceptance and there is a first for everything!

Here is the last of my rainbow bottle series "Blue Skies".  The last one for a while.  I have the coolest idea for a painting, and it will be my next painting after I finish moving!  Trust me I would much rather be painting.  Doing a self move is painful folks.  I have gained a huge respect for movers and am more than grateful to my amazing mother-in-law for putting on her Super Mom cape and saving the day.  She  came in and packed a majority of our house while watching our rug rats so that we could load and unload stuff at the new house.  Our saving grace is that we are only moving up the street.  The life of the military, we can now check of DITY (Do It Yourself) move off our list--well we will be able to check it off next week, I'll let you know if we survive:)

I also got word that my painting "Reminiscence" has been accepted into the 43rd Mid Southern Watercolor Society's exhibit.  I had a first experience with this show.  The show coordinator called me to let me know the only reason she didn't accept "Anticipation" is because of trademark issues.  I'm assuming that is a legit concern but since that painting has been published in Watercolor Artist, Splash 14, and a different Ball jar painting was accepted into NWS's show I was a little surprised.  So one more thing to think about.  She also didn't accept another artist's painting with Coca Cola bottles (not mine).  I'd love to hear your thoughts on that.  I think it would be extremely difficult to eliminate all trademarked items from still life paintings.

Friday Feature: Watercolor Wrap Up



Last weekend I held my 3 day watercolor workshop in Mt. Vernon, Illinois at the Shrode Art Center.  I had a fabulous group of students and just like every workshop and any time you get a group of artists together ideas were flowing.  I always think I learn just as much as my workshop participants.


We started on day 1 painting pears.  First in sepia and then in color.  This exercise gets everyone playing in their paint and working on getting strong values.  I also begin the day with a presentation.

On day 2 we began the day talking about my process and how I set up my till life set ups.  I showed a step by step demo of the painting we were going to be working on.  We painted "Spin the Bottle".  Everyone did a fabulous job painting glass, getting their values established and creating the 3 dimensional bottle.

Day 3 I talked about my favorite tools and websites, talked a little marketing and favorite books.  We worked on painting ball jars.

Thank You!

Hi Everyone,

I want to start out by telling you all a heart felt thank you for your messages, e-mails and fb comments about the loss of our sweet kitty.  It was very comforting! It was a bit of a rough weekend since this was the first experience with loss our little boys have experienced.  Sam our 3 year old was immediately sad but our 6 yr old Steven had a delayed reaction and was sobbing into the mid night hours.

Due to our emotional weekend I didn't get a whole lot of painting done.  I couldn't keep my mind on painting and opted to spend a family weekend.  I have progressed some but it feels like the painting that will never be done:)

Work In Progress Wednesday

Hi Everyone,

I'm plugging on through my large version of Lumos.  I will say after having painted a lot of ball jar paintings, I've lost count, that practice sure does help.  I'm almost on auto-paint.  I've worked most of these problems and solutions out on other paintings so this one is really a no brainer.  I can see now why people to studies. Oh and I took these pics with my ipad, not to bad!!  I have the hardest time taking pictures at night with my big camera.

On the home-front school starts next week for Steven.  He'll be in kindergarten.  I can't believe he'll be at school all day everyday:(  I have Sam going twice a week to a preschool program, hopefully I will get a lot of painting done on those days.

Lumos

Hi Everyone,

Did anyone else get swept away in magical wizarding world of Harry Potter?  I certainly did.  When the first book came out my hubby and I were living in Germany and couldn't wait to get our hands on an English copy, this was before Kindles.  They were sold out on base and I borrowed the book from our 13 year old neighbor.  She stayed up all night long reading the book after it's midnight release.  I stayed up the next night reading the book cover to cover and then passed it along to my husband who, in turn, did the same thing.  It was and still is a phenomenon.  So after I painted my first version of this painting for the fabulous Carol Carter, I was thrilled and flattered that Crystal Cook said she wanted me to paint her a version.  Crystal's son a fellow Potter fan said that the painting was cool and that it looked like something out of Harry Potter.  So in honor of the Cook's I am titling this painting "Lumos".  And because I just can't get enough of these ball jars I am painting an 18 x 24 version.

I did find it ironic that when I was saving the photo of this painting on my computer I titled it ball jars for CC, then realized that both owners of this painting have the initial CC (Carol Carter and Crystal Cook)  How cool is that:)

I'm back to my ball jars.  I like my comfort zone.  I'm having so much fun painting this one I was up until 4 a.m. last night.  A little break was all I needed and now I'm back in full painting force. 

Also this week while painting I had a huge REVELATION.  And I mean huge, as in will change my painting life forever.  You see every night I have a helper, or should I say more of a distraction.  Ella!

My favorite water bucket
Ella likes to supervise/sit on my paintings and loves to sneak paint water.  Which I am aware is super bad for her.  So because of Ella I bought this water bucket from Cheap Joe's.  I love, love, love this bucket it has 2 sides for water, a palette and a lid.  I recently ran out of room on my other palettes so I've been using the lid.  So as I was cleaning up I put the lid on my bucket.  The paint on that lid was dry as a bone and to my pleasant surprise today it was completely wet again, just like I had squeezed it from the tube.  The moisture from the water bucket reconstituted my paint overnight.  This is HUGE!!  I'm now going to attempt the same thing with my other palettes using wet paper towels and saran wrap, I'll tell you how it goes.  **I do know that some watercolor artists use fresh paint every time but the frugal side of me just can't do that. Plus some of my favorite color combos have come from my paint soup.

I want to give a big Thank You to Jack Richeson company.  I won a gift certificate from them as a prize from the LWS International Show.  I used the gift cert to get some extreme kolinsky brushes.  Not only were they super helpful, great on the customer service front, but they also covered the shipping costs.  Can't wait to use them:)

Work In Progress Wednesday

Hi Everyone,

I'm sharing some more of my work in progress (wip).  I'm working on this for the fabulous Crystal Cook.  I hope you don't get too tired of this painting because I'm planning on doing a large version.  The subject is pretty magical and I'm just itching to paint it at a large scale. 


I'm blogging this to you at 2:32 a.m.  A pretty typical blogging time for me, because I gravitate to night owl status very easily.  I thought I would share with you a typical painting evening at the Waller casa.  You would think that if I were painting into the wee hours it would be pretty quiet around here, but that is not usually the case.  Tonight I let the munchkins stay up a little later to watch the Olympics, I mean that is pretty exciting stuff.  The only problem with this is that when my kids get over tired they just get wired, so it took us a few books to get calmed down which now puts me at 11:30.  Then I had a little fb, website and blog business to tend to which always takes longer than anticipated.  My oldest child is still awake at this point (a natural night owl also) and he decides to "check" on me and see why I'm up so late.  So I went back in the boys room and tucked him in again.  I finally make my way upstairs to paint, I have a pounding headache but I'm going to paint my way through the pain and get some brush to paper.  The dog starts barking, have to go down let him out of his kennel and outside.  Put him back in his kennel, back to painting.  I'm happily painting away and get a text, it's my husband, texting me from the bedroom to check on Sam (I can't hear the boys from my art area and I "forgot" the monitor which is in the bedroom.  Go downstairs, Sam fell out of bed, still asleep, just crying in his sleep.  Pick him up, rock him, back in bed.  Back upstairs to paint again.  At this point I'm ready to hang my brushes up so I photo my work in progress and trudge back downstairs to blog to my wonderful blogging friends.  As I'm writing this my cat his meowing/ crying her little heart out because she wants me to come to bed, so she can sleep on me.  Guess I better wrap it up before the dog hears the cat and starts barking and wakes the boys up.  It's a regular circus around here:)  It's a miracle I ever finish a painting:)
